First-Offense DUI & DWI Penalties Under Maryland Law

Maryland distinguishes between DUI (driving under the influence) and DWI (driving while impaired). A blood alcohol concentration (BAC) of .08 or higher supports a DUI charge. A BAC of .07 or more but below .08 can still support a DWI charge. The penalties differ, and both carry consequences that extend well beyond the courtroom.

First-offense DUI maximums:

First-offense DWI maximums:

  • Up to 60 days in jail

Twelve MVA points from a DUI conviction is enough to trigger automatic license revocation proceedings by the Maryland Motor Vehicle Administration. If a minor was in the vehicle at the time of the offense, potential exposure increases to up to 2 years in prison and up to $2,000 in fines. Maryland doesn’t permit DUI or DWI convictions to be expunged, which means a conviction follows you through background checks for employment, housing, and professional licensing indefinitely.

Two Legal Tracks: Howard County District Court & the MVA Administrative Hearing

At the time of arrest, the officer issues an Order of Suspension, which also functions as a temporary driving permit valid for 45 days. To challenge the administrative license suspension, you must request a hearing with the Office of Administrative Hearings (OAH) within 10 to 30 days of receiving that Order. Missing the window results in automatic suspension. The OAH hearing is entirely separate from your criminal case. It addresses only whether your license should be suspended, not whether you’re guilty of DUI.

Administrative suspension lengths depend on BAC and circumstances. A BAC between .08 and .14 and a BAC of .15 or more each carry a 180-day suspension. Refusing a chemical test on a first offense results in a 270-day suspension; a second refusal triggers a 2-year suspension. Opting into the Ignition Interlock Program after the Order of Suspension is issued can let you drive immediately without serving the suspension period. Your criminal case is heard at the Howard County District Court in Ellicott City. If you request a jury trial, the case transfers to the Howard County Circuit Court.

    I am a retired Attorney who recommended a personal friend to Justin Lake. I received his name by speaking with an old friend of mine who is still considered one of the top criminal lawyers in Maryland. My friend was clearly guilty of driving while impaired as was evidenced by a video taken at the scene by the investigating officer and the fact that he failed the breathalyzer test.
